Temporary Accommodation (Section 188 & Section193)

Will the Council house me ('Priority Need & Temporary Accommodation') - Local Authorities only have a duty under Section 188 and 193 to provide accommodation for households that meet the criteria for 'Priority Need'. We can also look at the offer for suitable temporary accommodation and ensure the council meets the needs of your household as defined in the Homelessness Suitability Orders 2003, 2012 and 2022.

 

What is temporary accommodation?

Temporary Accommodation is a provision provided by the local authority of the household is homeless, eligible and meets the priority need criteria, Section 188 Temporary Accommodation is the provision provided whilst the local authority conducts enquiries into your application and attempts to resolve your homelessness, these provision can be shared or self-contained Bed & Breakfast Accommodation, that is charged at a nightly rate. However if the local authority is unsuccessful and a main duty of homelessness is awarded then the household tenmporary accommodation switches to Section 193, in which the coucnil must adhere to the statutory suitability orders.

 

Will the Council house me ('Priority Need & Temporary Accommodation')

The local uthority has a legal duty to accommodation a household if they are eligibile, homeless and in priority need. A household is in piority need if it has dependent children within the household, the applicant is either 16 or 17 years old, the household contains a vulnerable person (elderly or disabled), the household is fleeing due to domestic abuse or a person who has been in care and is under 21 years of age

If the household meets the criteria then the local authority will place a household into temporary accommodation, the offer of temporary accommodation must make provision of the household employment, educational, medical and support need and any caring responsibilites. MOst local authorities wil have a temporary accommodation procurement and allocation policy to prioritise those households that need local provision. Due to the limited supply a lot of local authorities are now placing households a distance from the area in which they previously resided
